Question 1: I found a grant posting on the internet with your email attached, I wanted to know if an idea for a more efficient generator would meet the requirements for the grant. If so, after the prototype has been completed and tested who retains ownership of the design?
Answer 1:

This funding opportunity seeks collaborative research, demonstration, and deployment partnerships that will enable the uptake of energy efficiency measures resulting in buildings that are constructed, retrofitted and operated to perform in small commercial buildings at scale across the U.S. and at the very low energy levels defined throughout the FOA (Architecture 2030 50% Challenge targets for new construction or at least 20% decrease in existing buildings). Successful applicant teams should show not only innovation in products, systems, technical, or business approaches, but also must demonstrate the ability and experience to deploy the solution to a segment of the small commercial building market through existing, realistic market channels.  The team must also show how the deployment model or strategy can scale nationally in the small commercial building marketplace, leading to significant, quantified national energy savings.  Research on technical AND/OR business solutions that underpin the deployment activities above and that can cost-effectively achieve energy savings must be available to the market at a scale to rapidly deploy and replicate.

 

Inventions are subject to Award terms and conditions if they are conceived or first actually reduced to practice under the Award.  Intellectual property terms and conditions for DOE financial assistance awards are set forth at 10 CFR 600.325 Appendix A. 

 

 

Question 1: Are multifamily properties eligible under this FOA?
Answer 1:

Small commercial buildings as defined in this FOA are 50,000 sq. ft. or less based on the Building Type Definitions included in the U.S. Energy Information Administration Commercial Buildings Energy Consumption Survey, at http://www.eia.gov/consumption/commercial/building-type-definitions.cfmThis definition does not include small buildings that house manufacturing operations.

 

 

Question 2: I am trying to build a Modern Castle with All Energy efficient Power supply and lighting with solar and led lighting and lead acid free capacitor banks and trying to design a new turbine generator. But I need $250,000 to build the Building and to build and test the generator and I need people to help manufacture it. I need to build and test it first.

On a non-competitive basis, interested parties may apply directly to the DOE for funding of an "Unsolicited Proposal."  DOE encourages the submission of Unsolicited Proposals that will contribute to its mission objective. DOE considers proposals in all areas of energy and energy-related research and development with emphasis on long-term, high-risk, high-payoff technologies.

An unsolicited proposal may be accepted by DOE if it:

•         Demonstrates a unique and innovative concept, or demonstrates a unique capability of the submitter;

•         Offers a concept or services not otherwise available to the Government; and,

•         Does not resemble the substance of a pending competitive solicitation.

 

The Unsolicited Proposal is the document intended to persuade the staff of the DOE and other qualified members of the scientific and engineering community who review the proposed work, that the project represents a worthwhile approach to the investigation of an important, timely problem. Each proposal should be self-contained and written with clarity and thoroughness. In the unsolicited proposal, the proposer must present objectives and the pertinence of the proposed work to DOE, the rationale of the approach, the methods to be pursued, the qualifications of the investigators and the institution, if applicable, and the level of funding required to attain the objectives. Question 5: Will it be possible to get a list of attendees? I'm looking for potential partners to submit a team application.

DOE does not intend to release any information regarding webinar attendees or potential FOA applicants. DOE will not be involved in the coordination of any applicant teaming arrangements.

Question 7: I am curious if our project would meet the criteria for this grant, in your opinion. My church is an old building with HVAC, roofing, and lighting dating back to the 1980’s. We are in the process of planning to install and energy star rated metal roof, replacing the old, low seer, HVAC equipment with 95% furnaces and high seer condensing units, high efficiency gas water heaters, and energy efficient lighting. All of this would certainly reduce our energy costs by far more than 20%. If you would, please advise me on this matter. Thanks for your time.

Question 9: If a team has two partners, one for R&D and one for commercialization, can the R&D partners of a team lead this project?
Answer 9:

Teaming arrangements are at the discretion of the applicant. Please refer to Section V.B.3.3, Capability and Resources of the Applicant/Project Team (page 50-51), for the criteria in which teams will be rated.   

 

Question 10: Are datacenter energy efficiency technologies, such as advanced thermal management of servers, of interest for this solicitation - assuming they meet the minimum efficiency improvements of 20% for existing building and 50% for new construction?

Question 12: I attended the webinar and was curious if you or your department will be making the “Concept Papers” available to the public? Also, do you have any recommended resources regarding conceptual energy efficiency ideas?
Answer 12:

DOE does not intend to publically release any Concept Papers. DOE will not recommend or prescribe any conceptual energy efficiency ideas beyond the descriptions included in the FOA document. It is up to a prospective applicant to review the FOA document and to propose a project of their conception.  

 

Question 13: I’m interested in viewing the full announcement for this RFP (DE-FOA-0000829 - Better Buildings: Commercial Energy Efficiency Solutions) but can’t seem to locate anything but the synopsis on the grants.gov site. Do you know if it has been posted? If so, could you point me to the appropriate page to download the full announcement?

Question 14: Which, if any, of the following building types meet the definition of "Commercial" for the purposes of this program · Multifamily rental? · Mixed-use (residential/retail/commercial)? · Schools?
Answer 14:

Small commercial buildings as defined in this FOA are 50,000 sq. ft. or less and would include multifamily, mixed-use, and schools.

 

Question 15: We are interested in applying, but have some questions we would like to discuss. Is it possible to speak with someone directly to ask these questions pertaining to the FOA?
Answer 15:

In an effort to uphold open competition, DOE cannot engage in direct communications with potential applicants. All questions must be answered in a public forum to foster equal opportunity.  

 

 

Question 16: Because of the need for DOE to get quality ideas and concepts to ensure that the funding for this program is spent well, it seems at first blush that the timing for responses is too short. Based on the short time-frame for applicants to clarify certain aspects of the Request for Proposals, gather partners, and draft a quality concept paper, would DOE consider extending the current due date for the concept paper and full application?
Answer 16:

At the current time, DOE has no intention of extending the Concept Paper or Full Application due date for this FOA.

 

Question 17: Can you clarify the cost share requirement of 50% of the total project cost? For instance, if we are asking for the maximum award of $2 million, we will need a cost share of $2 million (non-federal funding); making the total project cost $4 million. Is this correct?
Answer 17:

Correct, the maximum Federal share of an award will be $2 million. As 50% cost share is required, a project with DOE funding of $2 million would require $2 million in cost share for a total project cost of $4 million.

 

Question 18: Can a demonstration partner be a noncommercial entity, like a university?
Answer 18:

All entity types outlined in Section III of the FOA document are eligible to apply. Teaming arrangements are at the discretion of the applicant. Please refer to Section V.B.3.3, Capability and Resources of the Applicant/Project Team (page 50-51), for the criteria in which teams will be rated.   

 

Question 19: Do we need to know which facilities will be part of this grant before applying?
Answer 19:

Section V.B.2.3, Qualifications of Applicants (page 49) of the FOA document, states “A target market, defined by building type, business type, geographic location and/or other factors has been defined.

 

 

Question 20: Does commercial include multifamily?
Answer 20:

Small commercial buildings as defined in this FOA are 50,000 sq. ft. or less and would include multifamily.

 

 

Question 21: Does the project need to span a full 3 years, or can it be shorter? Does the spending need to be divided evenly across each year of the project? For a renovation project, it is typical for most spending to occur during the first year (during construction), with smaller amounts in following years for energy monitoring and analysis. Is this spending profile possible under this program?
Answer 21:

Awards are anticipated to run up to 3 years in length, subject to the availability of appropriations. Thus applications for projects shorter in duration are acceptable. Project budgets should be commensurate with project scope/tasks. Thus a project budget is not required to be evenly spread across each year.

 

 

 

Question 22: If we are currently a recipient of a Better Business Grant, are we still eligible?
Answer 22:

Previous Federal funding does not preclude applicants from eligibility under this FOA. However applicants should note that cost share funds may not come from Federal sources.   

 

 

Question 23: Is Davis Bacon also part of the documentation required?
Answer 23:

Davis Bacon Act requirements are not applicable to awards resulting from this FOA.

 

  

Question 24: Is the cost share 50% of the total budget? The example in the appendix of the FOA shows 20% for the R&D components and 0% for outreach
Answer 24:

All awards under this FOA are required to provide 50% cost share, regardless of project activity. The FOA appendix gives multiple generic examples of cost share calculations, however all awards under this FOA must meet the 50% requirement. 

 

Question 25: Paragraph 15 on page 45 of the FOA states "EERE generally does not fund projects that involve major construction." Would energy measures in either new construction or retrofit of a small commercial building (i.e. building envelope measures, HVAC systems, lighting, domestic hot water systems. etc.) be considered "major construction?"
Answer 25:

Distinct energy measures in new construction or retrofits usually would not be considered major construction; however DOE would need to review a proposed project before making a determination. Major construction typically involves the full cost of the construction, rather than distinct energy measures or retrofits.

 

 

 

Question 26: Will NEPA and/or Buy American apply for work undertaken by cost share partners on this work?
Answer 26:

Federal and Cost Share funding is subject to the same federal regulations. Thus all selected projects entire scope and funding (both Federal and cost share) are subject to a National Energy Policy Act review and to the greatest extent practicable, all equipment and products purchased should be American-made.

 

 

Question 27: Is the DOE project funding ($12MM total) for one year? Or for up to 3 years with project amount reduced if the project is not funded in out years?
Answer 27:

Total Federal funding, for all selected projects, which will be up to three years in duration, is $12 million. Projects may be up to three years, thus shorter projects are eligible as well. The maximum federal Funding is $2 million per project. This amount is not directly tied to the length of the project. Applications will be scored based on the criteria in Section V of the FOA document. 

 

 

 

 

Question 28: Does the 50% Cost Share Requirement mean that if I have a $500,000 project then $250,000 will have to come from the grant recipients?
Answer 28:

Correct, if the total project value proposed is $500,000 then $250,000 would need to be Cost Share.

 

Question 29: Please expand upon the cost share restriction listed on Pg. 26 of the FOA, “Bank loans from financial institutions”. Does this mean no cost share financing can be borrowed from a third party?
Answer 29:

Correct, loan funds borrowed from a financial institution which will later be paid back in full are not eligible to be used as cost share. Please refer to 10 CFR 600.30 and the applicable Cost Principles by entity type for additional information on allowable forms of Cost Share.   

 

Question 30: Can a municipality submit two Concept Papers, one as an internal City facility and one in collaboration with Private sector on a 3rd party site?
Answer 30:

No, one single entity may only submit one Concept Paper and one Full Application for consideration under this FOA. If an applicant submits more than one Concept Paper or Full Application, DOE will only consider the last timely submission for evaluation. Any other submissions received listing the applicant as the prime applicant will be considered non-compliant and not eligible for further consideration.

 

 

Question 31: Can Utility incentives count as a portion of a partners shared cost, either previously secured incentives or as part of the applied project?
Answer 31:

Discounts, incentives, and rebates are unallowable forms of Cost Share. Cost Share must be verifiable at the time of application. Non-cash Cost Share must have a verifiable market value. Please refer to 10 CFR 600.30 and the applicable Cost Principles by entity type for additional information on allowable forms of Cost Share.   

 

 

Question 32: Would a municipal building project for submission as a BBC showcase project qualify with the planned project being part of a larger performance contract phase with City share financing as an equipment lease purchase agreement?
Answer 32:

DOE will not make individual applicant eligibility or project viability determinations in advance of the application review process.  It is up to prospective applicants to review the requirements of the FOA and assess their eligibility and merits of their proposed project to determine whether to submit an application. 

 

 

Question 33: On page 17 of the FOA, it states that an applicant may only submit one concept paper and one full application. What constituents an applicant? Does this mean that our organization can only submit one concept paper? Or does this mean that each interested Principal Investigator (PI)can only submit one concept paper? I read your definition of application near the back of the FOA, but am still unclear on this. Perhaps it means that if we wanted to submit 2 or more concept papers, we’d have to have different partners for each one?
Answer 33:

Under this FOA, one organization/entity may only submit one application as the prime recipient. A single organization/entity may not submit multiple applications as the prime recipient regardless of different Principal Investigators or project partners. If an applicant submits more than one Concept Paper or Full Application as the prime recipient, DOE will only consider the last timely submission for evaluation.    

 

Question 34: On page 27 of the FOA, the requirement for a Contracting Officer letter for DOE national laboratories is described. Is the CO letter a deliverable with the concept paper? Or only with the full application?
Answer 34:

Submission of National Laboratory Contracting Officer Authorization is only required with the Full Application.

 

 

Question 35: Will an organization be allowed to submit multiple proposals as a prime applicant to this FOA, as long as unique Principal Investigators are listed on the applications?
Answer 35:

Under this FOA, one organization/entity may only submit one application as the prime recipient. A single organization/entity may not submit multiple applications as the prime recipient regardless of different Principal Investigators or project partners. If an applicant submits more than one Concept Paper or Full Application as the prime recipient, DOE will only consider the last timely submission for evaluation.    

 

Question 36: Will an investment in the efficiency of a new or retrofit construction project qualify as cost share?
Answer 36:

DOE cannot respond to cost inquiries including such vague terminology without knowing the specific project scope and cost specific details.  In addition, DOE will not make individual application cost viability determinations in advance of the application review process.  Please refer to 10 CFR 600.30 and the applicable Cost Principles by entity type for information on allowable forms of Cost Share. Please note that all project costs (both federal and Cost Share) must be within scope of the proposed project.  

 

Question 37: Under B-Cost Sharing, 3-Cost Sharing Types and Allowability (page 25-26) you state that the recipient may not use “Bank loans from financial institutions (loan meaning funds borrowed from a financial institution which will later be paid back in full)” as cost share. Our proposed program will partner with financial institutions to provide financing for energy efficiency projects. The proposed grant funds will be used to fund a revolving loan fund (RLF). Those funds will be used to match the bank financing through a co-lending agreement with the RLF portion being provided at low/no interest to bring down the cost of borrowing. In this type of situation, does the cost sharing restriction still apply?
Answer 37:

The cost sharing restriction still applies in the situation as described above. Recipients may not use bank loans from financial institutions as cost share.

 

 

Question 38: I did not see any reference to the usual federal requirement like Davis-Bacon wage rates, etc. I assume that if these funds are used for these projects that those regulations will apply?
Answer 38:

Davis Bacon Act requirements will not apply to awards under this FOA. The Davis-Bacon Act, codified at 40 U.S.C. 3141, generally applies to contracts between the federal government and another party for construction of public buildings.  Per section 1605 of the American Recovery and Reinvestment Act of 2009, it also applies to all projects funded in whole or part by ARRA funds.  This FOA does not meet any of the categories to which the Davis Bacon Act would apply. 

 

 

Question 39: I am looking for funding to help start my business; it will employ around 6 full time employees and be fully environmentally friendly alone with being energy efficient. Where do I need to apply for a green energy efficient grant?
Answer 39:

A list of all the current funding opportunities can be found at https://eere-exchange.energy.gov .  Please go to this website to see what FOA’s are currently available that fit your technology goals. All application submissions are to be made via the EERE eXCHANGE website at http://eere.energy.gov/financing/exchange

To gain access to the EERE eXCHANGE, the applicant must first register and create an account on the main EERE eXCHANGE site. This account will then allow the user to register for any open EERE FOAs that are currently in eXCHANGE. It is recommended that each organization or business unit, whether acting as a team or a single entity, utilize one account as the appropriate contact information for each submission.

The applicant will receive an automated response when the preliminary or full application is received; this will serve as a confirmation of EERE receipt – please do not reply to the automated response. The applicant will have the opportunity to re-submit a revised preliminary or full application for any reason as long as the relevant submission is submitted by the specified deadline. A “User Guide” for the EERE eXCHANGE can be found on the EERE website http://eere.energy.gov/financing/exchange/Manuals.aspx  after logging into the system.

Question 40: If a local government (a city of 2,200 population) only has one municipal building, can they still be eligible to apply for the grant?
Answer 40:

Population size has no bearing on the eligibility criteria for this FOA. Nonetheless, DOE will not make individual eligibility determinations in advance of the application review process.  It is up to prospective applicants to review the requirements of the FOA and assess the merits of their proposed project to determine whether to submit an application.   

 

 

Question 41: Can a City apply for a retrofit if they only have one Municipal Building?
Answer 41:

As stated in Section III.A.2 (page 23) of the FOA, “State, local, and tribal government entities are eligible to apply for funding as a prime recipient or subrecipient.” The number of buildings contained within a specified area has no bearing on applicant eligibility. Please read the full FOA document for the purpose of this FOA. It is up to prospective applicants to review the requirements of the FOA and assess the merits of their proposed project to determine whether to submit an application.

 

Question 42: I am a consultant who writes grants for [applicant name removed]. The [applicant name removed] is in desperate need of a new middle school. Can the School use this grant to construct a super-efficient middle school? Please let me know. If this is an eligible project we will submit a proposal ASAP.
Answer 42:

Question 43: I am considering applying for the “Better Buildings – Commercial Energy Efficiency Solutions” funding opportunity announcement. However, I am unclear of the deadlines for the Letter of Intent (LOI) and Concept Paper (CP). The Webinar presentation that is posted on the USDOE EERE website lists no deadline or requirement for LOI’s, but lists that CP’s are due on March 22nd. Please let me know if you can clarify these deadlines.
Answer 43:

Letters of Intent are not required for this FOA. The FOA submission deadlines are:  

·         Concept Paper Submission Deadline: 3/22/2013 5:00 PM ET

·         Full Application Submission Deadline: 4/24/2013 5:00 PM ET

 

 

 

Question 44: Page 9 of the FOA states: “If selected for award, EERE will request prompt documentation for environmental review including addresses of project worksites and information to show that sites are not historic properties, located within or immediately adjacent to a historic district, or 50 years of age or older. The term "historic property" is defined in the National Historic Preservation Act as: "any prehistoric or historic district, site, building, structure, or object included in, or eligible for inclusion on the National Register, including artifacts, records, and material remains related to such a property or resource.” May federal funds advanced under this award, and the corresponding cost share, be used only for non-construction activities (such as planning, research, technology, and administration) related to the proposed program, if other non-federal sources are used for construction activities in “historic properties” as defined in the National Historic Preservation Act (“NHPA”)?
Answer 44: DOE is requiring confirmation of whether the proposed project sites are historic properties, but not restricting eligibility based on historic property status.  The purpose of the applicant confirmation is to provide notice that historic property project sites are a consideration to DOE, as the identification of applications that will include historic properties will have an impact on award negotiations if that proposal is selected. 

All project costs within the entire project scope are subject to National Environmental Policy Act (NEPA) review and compliance, regardless of funding source. In addition, activities that are integral and supportive to associated projects may require further NEPA review of the associated projects to ensure NEPA compliance is met. The review process may, however, be more streamlined for non-construction activities. 

 

 

 

Question 45: May federal funds advanced under this award be used on “historic properties”, subject to documentation of compliance under Section 106 of the NHPA?

Question 46: Area 1 describes a deployment of a solution across a specific submarket of small commercial buildings. I interpreted this as deploying program services to a yet unidentified group of participants. Later in the FOA it suggests that specific buildings are desired and should be pre-identified for quick approval. Should all anticipated facilities be pre-identified and if not what percentage of facilities need to be pre-identified to meet the review needs alluded to?
Answer 46:

DOE is requiring confirmation of whether the proposed project sites are historic properties.  DOE is not requiring the pre-identification of all facilities or restricting eligibility based on historic property status.  The purpose of the applicant confirmation is to provide notice that historic property project sites are a consideration to DOE, as the identification of applications that will include historic properties will have an impact on award negotiations if that proposal is selected.

Question 47: To better understand the desire between deployment, market development and demonstration, what number range of facilities should we anticipate serving assuming a maximum award of $2M in funding?

Question 48: Are all building categories covered under Commercial Buildings Energy Consumption Survey included in the FOA’s definition of commercial buildings? If no, can you please indicate which categories are or are not covered in the FOA?

Personnel costs are commonly proposed costs in DOE Financial Assistance awards. All proposed project costs from selected awards will undergo a DOE budget review during award negotiations. This FOA does not restrict applications based whether the program is new or existing.  Proposals should concisely describe how the team, as led by a partner that exhibits deep understanding of the small commercial buildings market and has a demonstrated ability to implement market uptake programs, will move innovative energy efficiency models forward in at least one subsector of the small commercial buildings market.  Successful awards will fund the design and development of innovative technical and market uptake solutions, demonstration of the solution in at least one sub-market (geographic and/or building type), and development of plan to take the model to national scale.

This funding opportunity does not impose restrictions based whether the proposed project, model, solution, idea, etc. is new or existing.  This funding opportunity seeks collaborative research, demonstration, and deployment partnerships that will enable the uptake of energy efficiency measures resulting in buildings that are constructed, retrofitted and operated to perform in small commercial buildings at scale across the U.S. and at the very low energy levels defined throughout the FOA (Architecture 2030 50% Challenge targets for new construction or at least 20% decrease in existing buildings). Successful applicant teams should show not only innovation in products, systems, technical, or business approaches, but also must demonstrate the ability and experience to deploy the solution to a segment of the small commercial building market through existing, realistic market channels.  The team must also show how the deployment model or strategy can scale nationally in the small commercial building marketplace, leading to significant, quantified national energy savings.  Research on technical AND/OR business solutions that underpin the deployment activities above and that can cost-effectively achieve energy savings must be available to the market at a scale to rapidly deploy and replicate.

 

 

Question 58: As part of a proposal for deploying a scalable program, can funds be used for the enhancement of whole building audit software in order to make it more effective and scalable.

DOE will not make individual project viability determinations in advance of the application review process.  It is up to prospective applicants to review the requirements of the FOA and assess their eligibility and merits of their proposed project to determine whether to submit an application. 

 

Question 59: GHG reduction potential is a key aspect of the scoring criteria. Would a given proposal, all other aspects being equal, score better if the electric load of the selected geography is served primarily by coal (high GHG) than if the proposed geography had electric load served primarily by hydro (lower GHG)? We are interested to know whether GHG-to-energy savings ratio is important during the contract period, or is it really just the energy savings that is important because when the model is applied at scale, it will cover areas with high GHG fuel?

Applications under this FOA should identify the market(s) targeted by the proposed solution or idea and describe how that solution matches the goals of this FOA, linking the benefits of the proposed technology, solution or method to the targeted market(s). The target market may be defined by building type, business type, climate zone, geographic boundary and/or other factors.  Applicants should show the linkages of the issues and/or current market barriers to proposed idea and how it will be successful in the targeted markets.  Applicants should demonstrate experience and expertise in the targeted market(s).  DOE does not anticipate or assume any range or number of facilities, buildings or markets under this FOA. 

 

 

Question 62: Are there restrictions on the number of deployment partners? For example, could a proposal consist of more than one deployment partner or more than one research partner, and/or the addition of a software technology partner?

There are no restrictions on the number of project partners, regardless of entity type or project component.  

 

Question 63: What is DOE’s envisioned role of the demonstration partner? It’s not clear if this is meant to be a utility, a property management company, and ownership group, and association? The FOA isn’t particularly clear on what DOE seeks form this role.
Answer 63: Under this FOA demonstration partners should be able to apply solutions in actual building scenarios through demonstrated field/industry orientation and existing relationships and/or projects.  Demonstration partners should have a record of success in design, construction, service and/or other building professions.   Demonstration partners should be able to target an identified real-world application of the solution to show technical and economic feasibility, validate energy savings and other key metrics in at least one sub-market (i.e. geographic and/or building type) and prove the solution is ready for wide-scale deployment.
Question 64: Can DOE please confirm that the maximum award amount is $2 Million over three years?
Answer 64:

The maximum Federal share for an award is $2 million. With the addition of 50% recipient cost share, an award with $2 million in Federal funding would have $2 million in Cost share for a total project cost of $4 million.  The award period may extend up to three years.  

 

Question 65: The FOA states on page 76: "The applicant should...accurately illustrate the energy savings impact that their project is accomplishing over the course of the award period AND how the project/solution performance will meets the energy savings goals under this FOA." Could you please clarify what specifically are "the energy savings goals under this FOA"? Are these the 20% and 50% goals?

Buildings defined as “historic properties” are not precluded from applying to this FOA. However, all selected projects will undergo a National Environmental Policy Act review which will ensure such projects are in compliance with the National Historic Preservation Act. Such reviews may be more involved if project sites are designated as historic properties.  

The term "historic property" is defined in the National Historic Preservation Act as: "any prehistoric or historic district, site, building, structure, or object included in, or eligible for inclusion on the National Register, including artifacts, records, and material remains related to such a property or resource.” Thus project activities occurring at a building located within a historic district (even if less than 50 years old and non-contributing to the historic district) may still have an adverse impact upon the historic district and would potentially require further consultations as required by the National Historic Preservation Act depending upon the extent of the proposed activities.

 

 

Question 68: We seek clarification on the definition of “commercial buildings.” The FOA states: “The commercial real estate stock in the U.S. is dominated by small buildings - defined as less than 50,000 sq. ft.” The FOA does not distinguish between the type of activity taking place in a facility of that size (e.g. NAICS code of the end-user). Please advise on whether this grant can address energy-saving improvements on buildings of less than 50,000 square feet that house manufacturing operations, or if there are any other restrictions on building characteristics under this grant.

DOE is requiring confirmation of whether the proposed project sites are historic properties.  DOE is not restricting eligibility based on historic property status.  The purpose of the applicant confirmation is to provide notice that historic property project sites are a consideration to DOE, as the identification of applications that will include historic properties will have an impact on award negotiations if that proposal is selected.  All projects will undergo a National Environmental Policy Act (NEPA) review.

Can you confirm that this is necessary on top of the Page 30 requirements for the Concept Paper? If so, what are the specific requirements for the Abstract?
Answer 73: Please enter N/A into this Exchange field. The Abstract is a required internal field in Exchange in order to allow actual filing of the Concept Paper; however, it is not part of the Concept Paper requirements indicated in Section IV C. of the FOA.  There are no specific requirements for filling in the Abstract field in Exchange, and text entered into this will not be considered as part of the application review process.

Answer 75: If selected, all project costs, including cost share, will undergo a detailed DOE review to determine if they are allowable, allocable, and reasonable. While discounts, incentives, and rebates are unallowable forms of Cost Share, project costs for energy efficiency retrofits as contributed by the building owner may be allowable as cost share if they are within scope of the selected project. Cost share contributions by third parties such as subrecipients and project partners must submit a Cost Share Letter of Commitment at the time of application. Please refer to 10 CFR 600.30 and the applicable Cost Principles by entity type for additional information on allowable forms of Cost Share.
Question 76: I am planning to apply for the above grant for my company. I have begun the process of getting registered on all of the sites in order to be able to submit our Concept Paper by the deadline this Friday. I expect to receive my DUNS number today or tomorrow but in trying to obtain a SAM registration I have noticed that the site was down all day yesterday and now states that it won't be able to create new SAM memberships until next week. Is a SAM registration needed in order to submit the Concept Paper or just the Full Application? For the above FOA the Concept Paper is due this Friday but the full Application not until April 24th. I want to ensure that we will be able to submit our Concept Paper to be able to submit the Full Application later.

Providing Letters of Support to other applicants does not prevent an organization from either submitting a Concept Paper and Full Application on its own behalf or participating as a Project Partner on another application.

Question 81: I was in the process of registering in SAM's in order to apply for your Better Building Commercial Energy Grant. SAM's is currently experiencing technical difficulty according to their representative. The representative informed us that we will not be able to assess the system until Monday, March 25th after 9:00am.For this grant, the concept paper is due on Friday, March 22. I would like to request an extension until April 1, 2013 as we will need to be fully registered with SAM's in order for the system to allow us to submit our application.

I had checked EERE's listing just before the 7th when the FOA was announced. I also receive the EERE newsletter and updates and did not see anything about this FOA. During my regular scanning of the EERE website today I saw this for the first time just 2 hours after it had closed. I know that we have missed the deadline and your policy is very firm on no late acceptance, but given the short timeframe between the FOA being announced and the concept paper being due and the heartbreakingly good alignment between the FOA and our company, I had to contact you to plead my case. I wholeheartedly acknowledge that we missed the deadline, but I am wondering if there is any way we could submit a concept paper. Even if we only have until Monday, I think we can put together a very convincing case for our system. I hope that you can empathize with my situation as part of a very small startup with very few hours in the day for even the essential things like sleep. However, I understand if you have to stay true to your policy and will chalk this up to a learning experience that the EERE website must be checked at least twice a week.

However, it sounds like Letters of Commitment from said owners need to be provided at time of application, and therefore, all retrofit projects would need to be identified and agreements signed before April 24th. This scenario is unlikely given the short timeframe. As such, is it permissible for the grant applicant (and/or applicant partners) to provide a Cost Share Letter of Commitment that provides all matching funds in an escrow account, with project recipients later reimbursing the grant applicant?

The FOA seems to imply the latter, with failure to demonstrate performance resulting in DOE canceling disbursement of additional funds.
Answer 97: DOE typically fully funds all negotiated awards and conditions future Budget Period payments on successful Go/No Go Determinations at the end of each Budget Period. However DOE will determine the specific funding scenario during award negotiations on an individual award basis.   
Question 98: If our firm did not submit a concept paper, may we still submit for this grant?

Question 104: We were not invited back for a full application for DE-FOA-0000829: Better Buildings: Commercial Energy Efficiency Solutions. However, we are interested in reading / hearing comments from the review committee on our concept, if that’s possible. Will there be an opportunity to get that feedback?

As indicated in Section IV.C. 2 of the FOA, DOE will not provide technical feedback on Concept papers.  EERE makes an independent assessment of each Concept Paper based on the criteria in Section V.B.2 of the FOA.  A “discouraged” notification does not bar an applicant from filing a Full Application. Regardless of whether the applicant receives an “encouraged” or “discouraged” notification, DOE will review the Full Application so long as it is compliant and fits the FOA objectives.

Question 108: Can DOE funds be used to provide a rebate to reimburse a portion of the total cost for small commercial building customers who purchase and install a specific energy-saving measure? Or does the project team have to directly purchase and pay for installment of the measure?

For the purposes of this Funding Opportunity, DOE encourages projects that are sustainable and scalable.  While funding under this announcement may be used to pay for EE projects (rebates AND the direct payment of retrofits) in selected awards, this is not an approach that we would encourage as sustainable and scalable. Additionally, all proposed project costs from selected awards will undergo a DOE budget review during award negotiations. Costs will be reviewed to determine if they are allowable in relation to the entity specific Cost Principles and to ensure that they are allocable to the scope of the project and are reasonable. 

Question 109: Could DOE please confirm that the document type for the "1. Title Page/Abstract for Public Release" is indeed Microsoft PowerPoint and not MS Word? If it is PowerPoint, is there a template slide DOE would like us to use?

The Subaward Budget Justification must contain the same level of description and justification as described in Section IV. D. 2.  (#7) “Budget Justification (PMC 123.1).” This is the paragraph directly above the referenced text.   

Question 112: With the short turnaround between the "encouraged" notification and full application due date, we are unable to obtain signed 3rd-party cost share letters of commitment from state agencies with a 3 week standard turnaround. Is it permissible to propose cost share as a primary applicant commitment and transfer the obligation to the third party during the award negotiation phase?
Answer 112: If lead applicants propose all project cost share then third party cost share commitment letters are not required. Third party cost share contributions may be negotiated in the project negotiation phase; however if lead applicants propose all cost share and an award is negotiated they are responsible for all project cost share.

Answer 113: DOE does not plan to publically release any associated Budget and Reporting codes for this Funding Opportunity Announcement.

Specifically, if a subawardee is being allocated $75,000 in DOE funding and will likely be providing $75,000 in cost share, are they required to submit a separate budget justification, PMC 123.1?

The total work effort is the total requested award amount, including federal share and cost share.

Question 117: The formatting requirements in the application instructions for FOA 829 have internal conflicts – Which description do we go by?  See below. Section D provides these formatting requirements: • All pages must be formatted to fit on 8-1/2 by 11 inch paper with margins not less than one inch on every side. Use Times New Roman typeface, a black font color, and a font size of 12 points or larger (except in figures and tables). A Symbol font may be used to insert Greek letters or special characters, but the font size requirement still applies. • The Control Number must be prominently displayed on the upper right corner of the header of every page. Page numbers must be included in the footer of every page. However, the instructions for the title page/abstract call for no less than 11 point font. The instructions for the title page/abstract on p. 35 conflict with the instructions within the chart on page 33: Page 35 states: The project summary/abstract must contain a summary of the proposed activity suitable for dissemination to the public. It should be a self-contained document that identifies the name of the applicant, the project director/principal investigator(s), the project title, the objectives of the project, a description of the project, including methods to be employed, the potential impact of the project (i.e., benefits, outcomes), and major participants (for collaborative projects). This set of instructions says nothing about using PowerPoint, nothing about budget and cost share, and it has content guidance that would lead the writer in a different direction from the description in the chart on page 33. Which should we follow?
Answer 117: Either 11 point or 12 point font is acceptable. Applications must abide by all other stated formatting requirements.  The chart in Section IV. D. 2 of the FOA on page 33 provides a detailed description that applicants should closely follow. The narrative below the chart gives a more general description. For consistency purposes, applicants should follow the chart in Section IV. D. 2 of the FOA;  however, an application will not be deemed non-compliant if the applicants follow the instructions in the narrative on page 35.
Question 118: Our team was expecting to hear an answer on DOE FOA by now, so I just went onto our portal and saw the following: Response: Encouraged. Does that mean we were selected for final round submission? Were any formal emails/notifications sent out? Is the deadline still April 24? (seems very quick given lack of formalized response to applicants). Please let me know at your earliest convenience, because we have to mobilize resources in short order.
Answer 118: Encourage/Discourage notices are provided in Exchange. It is acceptable to update the budget with the Full Application to more accurately reflect the work specifically proposed in the Statement of Project Objectives.  Please note that, if selected, all project costs, including cost share, will undergo a detailed DOE review to determine if they are allowable, allocable, and reasonable, and the final budget will be determined in award negotiations. 

Question 120: Our understanding of the difference between letters of support and letters of commitment is that letters of commitment should come from entities providing cost share for the project, whereas letters of support should come from other entities that are not directly involved in the project and will not provide cost share or be a subrecipient. Can you please confirm this is correct. Part of the confusion is based on this sentence from Page 41, which seems to have gotten cut-off (it does not say whether letters of commitment for these parties should be submitted): "Letters of Commitment from parties participating in the project, exclusive of vendors, who will not be contributing cost share, but will be integral to the success of the project."
Answer 120:

Letters of Commitment are required from each third party contributing cost share.  A cost share commitment is not required in a Letter of Support.

Question 121: Our organization is the lead organization applying for funding. We also have multiple partners or sub-awardees applying with us. We are clear on the budget/budget justification requirements for sub-awardees. However, if one of our sub-awardees has a sub-awardee (aka our sub-sub-awardee) do they need to do the full budget justification if their cost share + DOE funds totals more than $100,000?
Answer 121:

A Budget Justification (PMC 123.1) is required for each sub-awardee that is expected to perform work estimated to be more than $100,00 or 30 % of the total work effort, whichever is less. This requirement would apply to any sub-awardee, regardless of tier.

Question 122: The FOA calls for references to the literature. However, there is nothing in the FOA about a references list. Do you want a reference list? References in footnotes or some other method for handling references?
Answer 122: The DOE would prefer references listed in footnotes; however, other methods would be acceptable as well.
Question 123: We submitted a proposal under Control Number XXXX-XXXX.   We have heard that the response was positive and it was recommended for a full application.  However, the primary contact does not want to pursue this opportunity any further.   Can we use this control number and partner with a different company that has the same size, scope, and marketability as the original partner?  Thank you for your cooperation.
Answer 123: In an effort to maintain fair and open competition, no new lead applicants may apply to this FOA. The lead organization that submitted  the Concept Paper must remain the prime applicant, however subawardees may change.  
Question 124: Can a for profit company receive profit for its portion of work scope under this funding opportunity?

Question 125: We are leveraging an existing incentive program that focuses on utility account holders.  Can we provide a nominal financial coordination incentive payable to the utility contracted program implementer to shift project focus to whole building?

Question 126: Can you please clarify whether SF-424 forms need to be completed by all subrecipients expected to perform work estimated to be more than $100k.  The FOA description indicates that a SF-424 needs to be completed just by the prime applicant (and NOT by subrecipients expected to perform work estimated to be more than $100k) and I want to confirm that this is the case.
Answer 126: The SF-424 Application for Federal Assistance and Budget Information SF-424A forms are required for the prime applicant only. A Subaward Budget Justification PMC 123.1 must be filled out for each subawardee that is expected to perform work estimated to be more than $100,000 or 30 percent of the total work effort (whichever is less).
Question 127: I have a question regarding the following item of Funding Restrictions (in page 45 of the FOA):  15. Construction.  EERE generally does not fund projects that involve major construction.  Recipients are required to obtain written authorization from the Contracting Officer before incurring any major construction costs. Does this mean that DOE funds cannot be used to pay for the installation of the ground heat exchanger in the demonstration part of our proposed project? The installation cost is about $250K for a 50,000 sf building.
Answer 127: DOE will not make individual application cost allowability determinations in advance of the application review process.  Please refer to 10 CFR 600.30 and the applicable Cost Principles by entity type for information on allowable costs.  Please note that all project costs (both federal and Cost Share) must be within scope of the proposed project and all cost share must be verifiable at the time of application.  All proposed project costs from selected awards will undergo a DOE budget review during award negotiations. Costs will be reviewed to determine if they are allowable in relation to the entity specific Cost Principles and to ensure that they are allocable to the scope of the project and are reasonable. As noted in the FOA, Recipients are required to obtain written authorization from the Contracting Officer before incurring any major construction costs, thus construction costs are not entirely prohibited.
Question 128: Please clarify the instructions for the SOPO.  The FOA states (page 34) a mandatory component of the SOPO is to include task sections clearly related to dollar amounts and to conform to the template on EERE exchange.  The instructions on the top of the template document include that dollar amounts should not be included in the SOPO.  Please clarify, should dollar amounts be included in the SOPO?
Answer 128: The SOPO should have tasks that can be clearly linked to the budget amounts included on the PMC 123.1,  Budget Justification; however,  the  budget amounts should not also be included in the SOPO.  
Question 129: I did not receive a reply to the initial email I sent you (attached) and have been reaching out to the wrong people in the hopes of getting a response from you.  We did not receive email communication about being encouraged to submit a full application. We have talked with other applicants who did receive an email. We now understand that we are being encouraged to submit a full application. Because of the lack of communication, we have lost valuable time in preparing our response.  Will we be able to get an extension on the deadline?
Answer 129: Individual encourage/discourage responses were not sent to applicants, only notifications to check EERE Exchange. As indicated on Page 2 of the FOA, DOE tries to respond to questions within 3 to 5 business days.  Your original email was dated April 16th.    Exchange Support informed you on April 18th  that you had received an “encourage” message in Exchange, which is within 2 business days.  DOE does not intend to extend the Full Application submittal deadline.  
Question 130: After the submittal of our concept paper, the consortium lead has dropped out. However, one of the already-existing sub awardees (in the concept paper) has stepped up to be the prime applicant. Is this acceptable? More details here: To clarify: Entity “A” submitted the paper and obtained the control number, but in first paragraph the concept paper states Entity “B” is the lead and Entity “A”, D, E, and F are partners. Now entity “D” is replacing “B” as the lead because Entity “B” has dropped out. Entity “A” has the control number and submitted the concept paper on behalf of the consortium and is still participating. Is this situation acceptable?

This section also requires 1 page resumes for each participating team member and optional 1 page letters of support from external entities, each that do not count toward this section’s page limit and should be included as an appendix. However, on pg. 39, the only detailed instruction for Item 3. Technical Qualifications and Resources is in regards to resumes, whereby it states “Save the Qualifications, Experience, and Capabilities in a single file titled ‘ControlNumber_LeadOrganization_Resumes’.” Does this mean that the 2 page summary of our resources and credentials, plus an appendix including both resumes and letters of support, will all be included in a single document titled ‘ControlNumber_LeadOrganization_Resumes’? Also, there is no instruction on file format. Are we correct in assuming it will be submitted in Adobe PDF format?

Reporting of the FOA document for reporting requirements.  If selected for award, the Terms and Conditions of the award will prescribe the reporting requirements via a Federal Assistance Reporting Checklist. This document will specify the frequency and due dates for the reports.

Question 135: On page 36 of the FOA, under the description of Project Overview/Background, it reads: “(Mandatory) The Applicant, discuss the history…”; Is this a typo, that should read “(Mandatory) The Applicant should discuss the history…”, or are you specifically looking for a description of the Applicant at this point in the narrative?

Question 141: For question/answer 112, you refer to a ‘project negotiation phase’. When is this phase? Is this after the funds have been awarded but before full commitment to utilize funds? We are also struggling with entities that are very interested in cost-share, but don’t have the time to fully commit to it under the April 24 deadline due to the necessary administrative steps they must take.
Answer 141: Following merit review of the full applications some applicants may be selected for award negotiations.  An award is issued only if negotiations are successful.  Please refer to Sections I. C. 5. and I. C. 6. of the FOA for further information.
Question 142: As you may be aware, on Friday the Boston area was brought to a standstill as authorities sought to apprehend the Boston Marathon incident suspects. Our organization, a lead partner on a proposal for DE-FOA0000829, which is due Wednesday April 24th at 5 pm, was virtually closed on Friday April 19. Suspension of public transit in the greater Boston area and other associated closures prevented nearly all employees from traveling to work. We are therefore behind on our preparations for the full proposal in response to DE-FOA0000829. We kindly ask that DOE grant a 24 hour extension to permit our team to submit our proposal by Thursday April 25th at 5:00pm. Answer 142:

DOE will allow a 24 hour application extension to applicants that had an office closure on April 19th, 2013 as a direct result of the incidents that occurred in Boston, Massachusetts. For such applicants, the application due date will be April 25th, 2013 at 5:00pm ET. Any applicant seeking this extension must provide an email request to the Funding Opportunity Question and Answer mailbox (BetterBuildings.CEES@go.doe.gov) by the close date of funding opportunity on April 24th, at 5:00pm ET. The request must provide a written statement that your organization was closed on April 19th 2013 due to the incident in Boston. Upon specific approval of the application extension, DOE will grant such organizations permission to submit their application via email attachment to the Funding Opportunity Question and Answer mailbox (BetterBuildings.CEES@go.doe.gov).   

Question 143: You mentioned the ability for a prime/sub applicant to offer cost-share, with the goal of securing a third-party who has already made a soft-commitment but needs more administrative time to confirm. And during the project negotiation phase, the prime/sub applicant can notify the DOE of this cost-share shift. In the unlikely event that the cost-share cannot be shifted during this timeframe, I assume the prime/sub applicant can withdraw the application before full awards are given out? Is that correct?
Answer 143:

Upon being selected for negotiations, both the DOE and applicant have the right to terminate negotiations without further obligation if an award agreement cannot be reached.  

Question 144: We were not able to upload our SF424 and abstract in time for this FOA. Is there any way we can still upload and submit?
Answer 144: Funding Opportunity DE-FOA0000829 is now closed and is no longer accepting applications.  
Question 145: I received a notice that replies to reviewer comments were available, however they do not appear when I log into Exchange. Is there a delay in the system?
Answer 145:

There was a very minor delay in the comments populating in the Exchange system. Please log into your Exchange account and try again as all comments populated on 5/17/2013.

Question 146: According to the schedule shown in the FOA, we were supposed to have at least five full working days to prepare responses to the Reviewer Comments, but we are only being given 1 ½ days to respond.  Can someone explain why?
Answer 146: As indicated in Section I. B. 3. of the FOA, applicants will have two  business days from the time the comments are posted to prepare and submit a Reply to Reviewer Comments.  Notification of the availability of Reviewer Comments was made to applicants on 05/17/13, with a due date of 05/21/13 at 5 P.M. ET to submit a Reply to Reviewer Comments.   Therefore, DOE has provided two full business days to submit comments as indicated in the FOA.
Question 147: We are preparing our response for comments we received on our application for DOE DE-FOA-0000829: Better Buildings: Commercial Energy Efficiency Solutions. We have several support letters and letters of commitment that came in after the application was due. Would it be appropriate to include these letters as an appendix to our comment replies to help clarify participation and commitment?
Answer 147:

No.  As indicated in Section IV. E. of the FOA, a Reply to Reviewer Comments is limited to clarifying aspects of the application and correcting misunderstandings. The reply may not be used to modify or materially change the submitted application.  This is to ensure that no organization has a competitive advantage over another by allowing application documents to be submitted after the deadline.  

Question 148: The FOA listed a July 1st date for selection notification. Given that the comment period was moved up two weeks, do you know if the selection notification date is expected to move up as well?
Answer 148: The actual selection notification date is subject to many variables; however, the expected notification date of July 1, 2013 has not changed.
